(article talks about how Lee Jaeseung, the 3rd VP of Seoul West District Prosecutors' Office only indicted YHS to pay 10M won for suspicion of gambling (which would usually fine you up to 3 years in prison and a fine of 20M won) YHS also exchanged over 400M won in foreign currency over a total of 24 times but was regarded as "simple gambling".
The case was handled by the police and sent to the prosecution, the lawyer being the same person who oversaw the YG/Jung Madam case and the prostitution case.
The court (judge Park Soohyun, from Seoul West District, turned to a formal trial and asked the prosecutor to consider the charges of habitual gambling in the first trial.
To judge the habitability of gambling, the gambling number and record have to be considerable, hence they are very important. However, even if there's no gambling record, the Supreme Court can conclude that "it is safe to assume 'habitual gambling' if the habit of gambling is recognized taking into account the nature, the scale of gambling, etc. So this leaves the judge free judgement over the case.
Lee Jaeseung violated the Act on Aggravated Punishment and the Road Traffic Act for another crime that happened in January 9th (dangerous driving and DUI). He was also charged with violation of Special Act on Insurance Fraud Prevention.
